B) ORAL COMMUNICATIONS: Pursuant to provisions of the Government Code §54957, this is the time provided for members of the public to address the City Council regarding matters of municipal concern (maximum of three minutes per speaker).

Judicial review of any City administrative decision may be had only if a petition is filed with the court not later than the 90th day following the date upon which the decision becomes final. Judicial review of environmental determinations may be subject to a shorter time period for Litigation, in certain cases 30 days following the date of final decision.
Any writings or documents provided to a majority of the City Council regarding any item on this agenda will be made available for public inspection o9at the public counter at City Hall located on the first floor at 1232 Washington Street during normal business hours.

I) PUBLIC HEARING
8) (1) Accept the County Certification that the Referendum Petition Against Resolution 2012-062 Approving the General Plan Overlay and Planned Development Goals for the Enchanted Resorts Properties Has the Requisite Number of Signatures; and (2) Reconsider Resolution 2012-062 and Either (a) Adopt a Resolution to Repeal Resolution 2012-062, or (b) Adopt a Resolution Submitting the Resolution to the Voters at a Special Election, and Consider the Designation of Council Members to Prepare Arguments in Favor of the Resolution
RECOMMENDED ACTION:
(1) By motion, accept the County Certification that the Referendum Petition against Resolution 2012-062 has the Requisite Number of Valid Signatures;
(2) Adopt a Resolution Submitting the Resolution to the Voters at a Special Election to be held March 5, 2013 and Requesting the Board of Supervisors of Napa County to Consolidate said Election with the March 5, 2013 Consolidated Election; and
(3) Designate one or two Council Members (Canning and Kraus) to prepare ballot arguments in favor of the Measure.
