A) CALL TO ORDER

B) ORAL COMMUNICATIONS:
Pursuant to provisions of the Government Code §54957, this is the time provided for members of the public to address the City Council regarding matters of municipal concern (maximum of three minutes per speaker).

NOTICE: If you challenge a city’s zoning, planning, or other decision in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the City Council at, or prior to, the public hearing. Judicial review of any City administrative decision may be had only if a petition is filed with the court not later than the 90th day following the date upon which the decision becomes final. Judicial review of environmental determinations may be subject to a shorter time period for Litigation, in certain cases 30 days following the date of final decision.
PLEASE NOTE: Any person who wishes to speak regarding an item on the agenda or make a comment under the “Oral Communication” portion of the agenda may voluntarily complete a “Speaker Card” and submit it to the City Clerk BEFORE that portion of the agenda is called. Speaker cards are available on the table in back of the room. Please observe the time limit of three minutes.

Any writings or documents provided to a majority of the City Council regarding any item on this agenda will be made available for public inspection at the public counter at City Hall located on the first floor at 1232 Washington Street during normal business hours.

This time is set aside to receive comments from the public regarding matters on the Consent Calendar or matters of municipal concern not on the agenda. Pursuant to Government Code section 54954.3 (the Brown Act), however, the Council cannot consider any issues or take action on any requests during this comment period. Speakers are encouraged to limit their comments to 3 minutes maximum so that all speakers have an opportunity to address the City Council.

1) Appreciation award to Firefighter Jason Tamagni for five years of service to the Calistoga Fire Department.

2) Appreciation award to Firefighter Joseph Russo for his ten years of service to the Calistoga Fire Department.

3) Appreciation award to Parking Enforcement Officer Herbert “Art” Collins for his ten years of service to the Calistoga Police Department.

4) Presentation by Harriett Dietz with the Area Agency on Aging (AAOA).
RECOMMENDED ACTION: Receive report.

H) CONSENT CALENDAR
5) Minutes of the August 14, 2012 special City Council meeting.
RECOMMENDED ACTION: Approve minutes.

6) Consideration of a Resolution approving the 2013 Parade List and authorizing the Public Works Department to apply for Encroachment Permits from Caltrans.
RECOMMENDED ACTION: Adopt Resolution.

7) Presentation by individual applicants for the vacant City Council position.

8) Discussion and consideration of a Resolution regarding City Council Appointment to fill the Council vacancy created by the resignation of Councilmember Carl Sherrill.
RECOMMENDED ACTION: Adopt Resolution.

9) The City Clerk will administer the Oath of Office to the newly appointed City Councilmember, should one be appointed, who will then assume his or her seat.

10) Consideration of a Resolution confirming the Mayor’s appointment to the Calistoga Green Committee.

13) Fiscal Year 2012-13 Mid-Year Review and Budget adjustments
RECOMMENDED ACTION: Receive Mid-Year 2012-13 Budget Report and Adopt Resolution Approving Operating and Capital Improvement Budget Adjustments for Fiscal Year 2012-13.

14) Discussion and direction regarding the response letter in regards to Kimball Bypass concerns by the State Water Resources Control Board.
RECOMMENDED ACTION: By motion, authorize the City Manager to send a letter to the State Water Resources Control Board to respond to Kimball Bypass concerns.
