This time is set aside to receive comments from the public regarding matters on the Consent Calendar or matters of municipal concern not on the agenda. 3) Consideration of an amendment to the Calistoga Municipal Code adding protection for farmers who use accepted and standard farming practices against nuisance suits and requiring disclosure about the potential inconveniences and discomforts associated with agricultural operations. (second reading)

4) Consideration of a Resolution approving a Budget Adjustment in the amount of $50,000.00, to recognize program funding and appropriations for Professional Services for the Fair Way Path Extension during fiscal year 2013-14.

5) Consideration of a Resolution authorizing the filing of an application for signalization of SR 128 and Petrified Forest Road for the 2014 Regional Transportation Improvement Program Funding assigned to the Metropolitan Transportation Commission and committing any necessary matching funds and stating the assurance to complete the project.

6) Consideration of a Resolution authorizing the Mayor to execute a Master Program Agreement No. 04-5061R, and authorizing the City Manager to execute Program Supplement Agreement No. 004-N for the Berry Street Bridge Project, and future Program Supplement Agreements with the State of California, Department of Transportation.
RECOMMENDED ACTION: Adopt Resolution.

H) PUBLIC HEARING

7) Consideration of a Planning Commission Recommendation to deny an Amendment to the Downtown Commercial Zoning District to allow walk-up building facilities housing automated teller machines (ATMs).
RECOMMENDED ACTION: By motion reject the requested ordinance amendment, or direct staff to set a hearing date for consideration of the proposed amendment.

8) Consideration of an Amendment to the Calistoga Municipal Code regarding Calistoga Municipal Code Section 6.04 Animal Control.

RECOMMENDED ACTION: By motion, summarily deny the appeal and sustain the Planning Commission’s action, or decide to hear the appeal and set a public hearing date.

13) Consideration of a Resolution Approving Amendment No. 12 of Napa County Flood Control and Water Conservation District Agreement No. 1926 Relating to an Addendum to the City of Calistoga’s Settlement Agreement and Release with Napa County Flood Control and Water Conservation District and Authorizing the Mayor to Execute both Agreements
RECOMMENDED ACTION: Adopt Resolution.

14) Consideration of a Resolution authorizing the City Manger to execute a Professional Services Agreement (PAS) with URS Corporation in the amount not to exceed $180,495.00 to provide environmental review, permitting and design engineering service for improvements to the Kimball Reservoir Intake Tower, Drain Valve and Piping System Project (the Project) and approving a budget amendment in the amount of $50,000.00 derived from Measure A proceeds.
RECOMMENDED ACTION: Adopt Resolution
